The former Brazilian leader has been taken into custody after authorities concluded he posed a definite escape threat while under house arrest.

The former head of state was found guilty of orchestrating a government overthrow in September and sentenced more than 27 years in incarceration, but he remained under confinement pending appeals.

High Court Judge Alexandre de Moraes said the move to detain the septuagenarian politician was a preventative measure after recent developments were revealed.

This involved seeking to disable his electronic bracelet and a call for a demonstration that could facilitate a possible escape.

Court Filing Details Escape Risks

In a filing authorising the detention, the magistrate said information from the facility tracking the former president's confinement suggested the one-time head of state's aim to disable the surveillance device to guarantee victory in his getaway".

This, it said, would be made easier by the disorder caused by the gathering called by his offspring.

His child, his son Flávio, who holds office as a legislator, called for a gathering of his followers near Bolsonaro's home to take place on Saturday night.

His son wrote on social media on the previous day: "Are you going to fight for your nation, or watch it all from your phone there on your settee? I call on you to struggle with us."

He said the gathering would be so supporters could seek divine intervention for his physical condition and for the return of democracy in our country."

Foreign Shelter Risks

Part of Justice Moraes's determination was the potential of his transfer to foreign missions near the dwelling, considering that the inquiries revealed a history of organizing to ask for protection through a consular facility", a statement said.

Recent Legal Requests

It was only on last Friday that the ex-leader's attorneys asked the High Court to permit him to serve his whole jail sentence under home confinement, with tracking devices.

They also asked that he be authorized to leave his home for healthcare, saying he needed frequent medical attention for pulmonary infections and other illnesses.

Context of Sentencing

He was convicted of orchestrating a plot aimed at maintaining his control after he was defeated in the presidential race to his ideological adversary, Luiz Inácio Lula da Silva.

High Court judges said that he had knowledge of a scheme which encompassed plans to assassinate the current president and his VP candidate, Alckmin, and to detain and kill Justice Moraes - the High Court judge who has been managing the former president's case.

The conspiracy was prevented because it couldn't obtain the endorsement of the armed forces officials. His successor was took office without issue on the first day of 2023.

But a seven days after, on 8 January, numerous Bolsonaro supporters stormed and vandalised official structures in the national capital, Brazil's capital.

The law enforcement stepped in and around approximately 1,500 persons were taken into custody.

The judges found that the protesters had been encouraged by Bolsonaro whose plan, they said, was for the national armed forces to step in, restore order and bring him back to power.

At the period, the legal team called the decades-long sentence extremely harsh.

He was also prohibited from running for public office until 2060 - eight years later after the completion of his term.

The ex-leader called the trial a targeted investigation" and said it was aimed at blocking him participating in the 2026 national vote.
